MARRIAGE AND DIVORCE
Marriages of Algerian citizens with foreigners can be registered if they have been performed according to the legal procedures of the country of residence and with respect to the Algerian legislation.
The registration of the marriage of an Algerian woman and a non-Muslim man is inadmissible, unless the certificate is accompanied by a Certificate of Embracing the Islamic Faith (Certificat de Conversion à l'Islam) issued by a mosque of the religious empowered authority for non-Algerian husbands.
Required documents:
- Original Greek or Albanian marriage certificate
- Official translation from the Greek Ministry of Foreign Affairs in both Arabic and French languages
- Algerian identity document and if one of the spouses has another nationality, photocopy of passport or birth certificate
At the end of this registration procedure, a family record booklet is issued by the Embassy of Algeria in Athens and given to the spouses.
Divorce – Exéquatur
In order to perform the transcription of every divorce decree in the registries of our Embassy in Athens; an act of execution (Exequatur du jugement de divorce) must be further obtained from the Algerian competent authority. (Even if the marriage transcription has been performed by our Consular department).
In case of divorce, please note that the citizens have to present an application of divorce-exequatur before the competent Court of the place of birth if born in Algeria or the court of Sidi M’Hamed –Algiers if born abroad.
Required documents:
- Original document of the Greek or Albanian divorce judgement
- Original document of the notification of the decision to the concerned party
- Certificate from the Registrar that there is neither opposition against the decision nor any appeal or appeal in cassation.
